Article 15 of the Act of 13 June 2005 on electronic communications prohibits causing “harmful interference”.
It is also prohibited to hold, market, import, own or use products that may cause such interference.
The new Article 15/1, introduced at the end of 2023, groups together the users benefiting from an exception to this prohibition but who will have to comply with certain conditions, in particular notifying the use of such a device.
This decision implements the legal authorisation given to BIPT to lay down the terms of such notification and the information to be provided in this context.
