Update
This judgement of the Market Court of 10 May 2023 does not affect the objections raised against Telenet (insufficient security measures for one of its sites).
However, the Market Court declares that the BIPT should have taken several mitigating circumstances into consideration, i.e. (1) the absence of deliberate intention from Telenet and (2) the impact of the ongoing investigation carried out by the legal expert regarding the deadline to take the necessary measures.
Given these mitigating circumstances, the Market Court has reduced the fine from €190,000 to €150,000.
