The BIPT issued an opinion at the request of the Committee for Economy, Consumer Protection and the Digital Agenda of the Chamber of Representatives regarding the bill amending the Act of 13 June 2005 on electronic communications and the Code of Economic Law so that advertising calls are only authorised upon explicit consent.
In its opinion, the BIPT indicates the following:
- In the event of the implementation of a system aimed at obtaining explicit consent from users for direct marketing calls, the proposed amendments to the Act of 13 June 2005 on electronic communications seem necessary;
- The impact of the system for obtaining explicit consent from users for direct marketing calls should be analysed while taking account of the fact that call centres/operators making calls for direct marketing purposes are often located abroad.
