With this decision BIPT finds that Belgacom has ignored the transparency obligation imposed on it by the market analysis of 10 January 2008 regarding the broadband access market, as corrected by the renewal decision of 2 September 2009 and the CRC decision of 1 July 2011 on the analysis of broadband markets, and imposes a penalty on that company.

For the sake of transparency towards market players, BIPT has decided to clarify the approach that will be adopted assuming that BIPT has to verify the universal service net cost calculation of the universal service provider and to publish a communication on this subject. In order to determine the net cost of the universal service the postal operator subject to the universal service obligations has to be compared with the same postal operator without the universal service obligations, which means it is necessary to know the differences in cost and revenues in the patterns with and without the USO. Thanks to this approach, it is possible to determine the net cost of the universal service provision for the operator.
