In the context of its 2018 analysis of the broadband and broadcasting markets, the CRC has imposed a remedy for access to (sections of) ducts of the FTTH GPON network of Proximus. The remedy concerns the (sections of) ducts when the end users are connected by such ducts from end to end.

Following the decision on the analysis of the broadband and television broadcasting markets of 29 June 2018, BIPT reviews the tariffs charged to alternative operators for services carried out by Proximus within the framework of the BRUO and Bitstream xDSL reference offers. Those include the services regarding a line activation or migration and the guarantees in terms of repair (“ISLA Repair’).

This decision of the CRC concludes that Proximus, Telenet, Brutélé and Nethys have significant market power on the wholesale markets for broadband and television. Therefore, a certain number of obligations are imposed on these operators, in particular the obligation to open their networks to competing operators.
