The BIPT has delivered a positive opinion on the draft Royal Decree replacing the Royal Decree of 19 September 2013 implementing Article 126 of the Act of 13 June 2005 on electronic communications (“Telecom Act”).
The draft Royal Decree no longer sets out the data to be retained by operators, as these data are now included in articles 126 and 126/2 of the Telecom Act, following the amendment of the latter by the amending act on "data retention", adopted on 20 July 2022. It is limited to setting out certain technical requirements to be complied with by operators during retention and to specifying certain technical or procedural points.
