On 23 August 2022 the BIPT imposed a fine on Telenet for not having taken sufficient security measures to protect one of its sites against storm Eunice and to secure the physical access to the site.

Against that decision Telenet submitted a request for annulment before the Market Court.

In its judgment of 10 May 2023 the Market Court confirms the BIPT’s task to ensure that the safety of the operators’ electronic communications networks and services remains effectively guaranteed.

In that situation the BIPT can require a failing operator to take appropriate measures and it can also impose fines.
