Summary of 30 June 2015 of the contributions to the consultation organised by the BIPT Council on 22 January 2015 regarding the designation procedure of the universal service provider

Bpost is charged with the universal postal service until 31 December 2018, in accordance with Article 144octies, § 1, of the Act of 21 March 1991 on the reform of certain economic public companies. The same provision states that the designation procedure of the universal service provider who will succeed bpost shall end at the latest three years before the end of the previous designation, i.e. before 31 December 2015. The Royal Decree of 19 April 2014 amending the Royal Decree of 11 January 2006 implementing Title IV (Reform of the Postal Authorities) of the Act of 21 March 1991 on the reform of certain economic public companies has introduced, in this Royal Decree of January 2006, a new Title VI laying down the designation procedure of the universal service provider and entrusting BIPT with the practical organisation of this procedure in name and on behalf of the Belgian State. Within this framework, a public consultation regarding the designation of the universal service provider was held from 22 January 2015 to 6 March 2015. BIPT has received 6 contributions. This document contains the summary of the contributions received. This draft summary mentions the name of most of the participants to the consultation. The responses to each of the questions asked have been summarized, the name of the respondent to the question has been made anonymous.

Draft decision revising the wholesale tariffs of services for cable network access in the bilingual Brussels-Capital Region

This decision aims to revise the tariffs of the wholesale services the provision of which is imposed on the cable network operators who are active in the bilingual Brussels-Capital Region (Brutélé, Coditel and Telenet). The wholesale services involved are:
Resale of analogue television services;
Access to the digital television platform;
Resale of broadband services.

Draft Decision of 24 March 2015 regarding the addendum to the BRxx reference offers "SNA, Splicing Interventions & XML Done Timer"

On 5 May 2014 Belgacom transmitted a proposal to BIPT regarding the adaptation of the BRUO, BROBA and WAB VDSL2 reference offers, in short BRxx, in relation to the process of splicing, the repair process and the calculation of the SLA XML Done Timer. In that new proposal Belgacom introduces the following amendments:
It introduces, in conformity with the BIPT Council Decision of 10 December 2013 (BRxx 2012 decision) a service guarantee (SLA) as well as a compensation for the splicing interventions carried out following a defect found in the Belgacom network.
Belgacom also wishes to introduce a new element of compensation through this proposal, namely the invoicing of fruitless trips of technicians in the context of the repair process.
Finally Belgacom wishes to adapt the SLA XML Done Timer in order to no longer take into account the Certified Technicians orders, in short CT.
The suggestions to adapt the aforementioned BRxx offers are the subject of this draft decision.

Draft decision of the BIPT Council on the division of spectrum in the 900 MHz band

This consultation concerns the division of spectrum in the 900 MHz band between 27 November 2015 and 15 March 2021.
By virtue of point 9.6 of the decision of 15 December 2014, Belgacom and Mobistar had to submit a 900 MHz band redeployment plan to BIPT including the intermediate steps. However, the division of spectrum proposed by the operators is different from the one provided for in the decision of 15 December 2014.

WIK study « Review of the postal market three years after full market opening on 1 january 2011 »

Since 1 January 2011, the Belgian postal market has been fully opened to competition. In November 2014, BIPT, wishing to review the situation after three years of postal liberalisation, entrusted an external consultant, WIK-Consult GmbH, with the task of drawing up a report aiming at comparing the market situation before and after its liberalisation, assessing the impact of the opening to competition and identifying possible remaining barriers in the Belgian postal market. Based on the economic analysis of the Belgian postal market during the2011-2014 period as well as the analysis of the current regulatory framework, and comparing the Belgian results to those of other European countries, WIK draws a series of conclusions leading to recommendations. The analysis carried out by WIK as well as the ensuing conclusions and recommendations are included in the enclosed report 'Review of the postal market three years after full market opening on 1 January 2011'. It should be noted that the opinions and proposals expressed in this study are only those of the authors.
