Directories

The basic regulatory provisions on the directories are laid down in Article 45 of the Electronic Communications Act of 13 June 2005.

This regulatory framework states that:

  • anyone wishing to provide an enquiry service, is obliged to submit a declaration with BIPT;
  • operators providing telephone services have to make their subscribers’ data available to the providers of enquiry services under fair, reasonable and non-discriminatory technical, financial and commercial conditions;
  • providers of enquiry services may only use the data they've received to provide the enquiry services;

A Royal Decree of 27 April 2007 on the telephone enquiry service determines more in particular the content and form of the declaration that has to be made when someone wishes to provide an enquiry service.

An Opinion of 18 February 2009 defines the terms to be met by operators providing telephone services to communicate the data of their subscribers to the enquiry service providers.

Directory enquiry services

The basic regulatory provisions concerning directory enquiry services are laid down in Article 46 of the Act of 13 June 2005 on electronic communications.

This regulatory framework provides that:

  • Each person wishing to provide a directory enquiry service shall make a declaration to BIPT;
  • Operators providing telephone services shall make data concerning their subscribers available to providers of directory enquiry services under technical, financial and commercial conditions on a fair, reasonable and non-discriminatory basis;
  • Providers of directory enquiry services may solely use the received data for the provision of directory enquiry services.

A Royal Decree of 27 April 2007 on telephone directory enquiry services defines, among other things, the content and the form of the declaration to make when a person wishes to provide a directory enquiry service.

An Opinion of 18 February 2009 specifies how operators providing telephony services must provide directory enquiry service providers with data concerning their subscribers.

The persons who have made a declaration pursuant to Article 46 of the Act of 13 June 2005 on electronic communications and Article 2 of the Royal Decree of 27 April 2007 on directory enquiry services are the following:
