The present draft decision is set within the framework of Article 7, § 2, subsection four, of the Annex to the Act of 13 June 2005 on electronic communications (hereafter "ECA"). The goal of the present draft decision is twofold: the definition of the cases in which the fix times for defects on the access lines are not taken into account for the monitoring of the compliance with the quality requirements as mentioned in Article 7, § 2, of the annex to the ECA, as this regards cases the provider has no control over and that cannot be attributed to an error on his behalf; the definition of the terms and conditions for communication and approval of the causes justifying his non-compliance with his obligations as stated by the universal service provider. Deadline for answers: 29 July 2014.

In accordance with the Postal Act (Article 148bis, §2 of the Act of 21 March 1991), postal service providers shall commit themselves to comply with "the obligation to make it possible for the population to identify the persons in charge of the delivery of postal items and ensure that the postal items, with the exception of newspapers, bear a mark allowing the identification of the service provider that treated this item". By virtue of the legal prescription, each postal service provider involved in the transport process of postal items should therefore mark the postal items in order to allow its identification. However, this marking obligation can make the operational processes more complex and therefore result in additional costs. BIPT wishes to obtain the opinion of the different parties (operators, consumer associations, etc.) concerned by this marking issue. Answers to this consultation are expected during the four weeks of this publication, by Wednesday, 2 July 2014 at the latest.

The purpose of this communication is to explain the notion of "operator" as well as the hypotheses in which a person has to submit a notification to BIPT as an operator. This communication is not exhaustive and will evolve according to the specific cases BIPT will be confronted with, the feedback from stakeholders and the need to study certain notions in depth. This communication is based on the principles that apply. This does not exclude the fact that in some specific cases BIPT may still adopt ad hoc decisions.
