This decision allows the implementation of the principle of technological neutrality in the 2GHz band. With this decision BIPT finds that Belgacom has ignored the transparency obligation imposed on it by the market analysis of 10 January 2008 regarding the broadband access market, as corrected by the renewal decision of 2 September 2009 and the CRC decision of 1 July 2011 on the analysis of broadband markets, and imposes a penalty on that company.

The Act of 10 July 2012 pertaining to various provisions regarding electronic communications has added, among other things, an Article 114/1, §2, to the Actof 13 June 2005 on electronic communications (hereinafter ECA). This article reads as follows (emphasis added): "The undertakings providing publiccommunications networks or publicly available electronic communications services shall immediately notify the Institute of a breach of security or loss of integrity that has had a significant impact on the operation of networks or services. Following the prior consent of the Minister, the Institute shall specify in which hypotheses the breach of security or loss of integrity has a significant impact in the sense of this paragraph." This decision implements, among other things, the last sentence of the above-mentioned provision.

In this decision BIPT imposes on Schedom Dommel a 5,000 EUR fine due to the illegitimate mentions in its general terms and conditions. These illegitimate mentions include among other things the lack of information that is obligatory by law, the disregard of consumers legal options to cancel a contract, the use of excessively long tariff formulas etc.

This decree concerns the application of Article 32 and Article 34, 2°, of the Royal Decree regarding the implementation of Title IV of the Act of 21 March 1991, i.e. the monitoring and the publication of the delivery times of the following five services that are part of the small users basket: - domestic priority single piece mail; - domestic non-priority single piece mail; - domestic registered single piece mail; - domestic single piece postal parcels; - incoming priority cross-border single piece letter post.
